Terms and Conditions for SnapDraw

1. Acceptance of Terms
By accessing or using Snap Draw ("the Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use the Platform.
2. Platform Overview
SnapDraw provides tools and services that enable users to create, manage, and promote raffles and giveaways. The Platform does not operate or participate in the management, conduct, or outcome of any raffle. Payments (where available) are processed by Stripe. We use Stripe Connect to facilitate payments and route proceeds to verified host (organizer) Stripe accounts. SnapDraw does not store complete card details and does not receive customer funds into a SnapDraw bank account.
2A. Service Availability & Eligibility (Australia)
- Hosts (organizers): The hosting features of SnapDraw are intended for Australian organizations only, such as charities, not-for-profits, schools/P&Cs, and sporting clubs that are eligible to conduct raffles under Australian laws. An active ABN and compliance with the relevant state/territory rules are required.
- Participants (buyers): The Platform is marketed for use in Australia and by Australian residents, and participation must comply with the laws of the jurisdiction where the raffle is conducted. Participation is 18+ only where required by applicable law. The Platform is void where prohibited.
- Geographic restrictions: We may restrict or suspend access to the Platform from outside Australia, or where local laws prohibit participation.
- No legal advice: Nothing on the Platform constitutes legal advice. Organizers are responsible for ensuring their raffles are lawful in the relevant Australian state/territory, including permits, prize restrictions, disclosures, and record-keeping.
3. User Responsibilities
- You are solely responsible for ensuring that any raffle or promotion you create or participate in complies with all applicable local, state, and national laws and regulations, including gambling, trade promotions, and fundraising laws.
- You must obtain any necessary licenses, permits, or approvals before running a raffle. The Platform does not verify or assume responsibility for user compliance.
- You agree not to use the Platform to conduct illegal raffles, fraud, or misrepresentation. Any breach may result in immediate suspension or termination of your account.
3A. Compliance & Organizer Responsibilities
- Organizer status: Only eligible organizations (e.g., charities, P&Cs, sporting clubs, or other authorized NFP bodies) may host raffles, subject to applicable law.
- Permits/licences: Where required by local law (e.g., by state/territory thresholds), organizers must obtain and maintain valid authority/permit numbers and provide them to buyers.
- Disclosures: Organizers must disclose organizer name/ABN, permit/licence number (if applicable), draw date/time/place, prize details, and any material terms (refund/redraw policies).
- Eligibility: Organizers must ensure tickets are sold only to eligible participants (e.g., 18+ where required) and within permitted jurisdictions.
- Records: Organizers must keep fair draw records and comply with winner notification/announcement obligations and any reporting required by regulators.
4. Platform Fees
- We may charge subscription fees or one-time payments for access to premium features. All such fees are for use of the Platform only and are not connected to the proceeds or outcomes of any raffles.
- We do not take a percentage of ticket sales unless explicitly disclosed to you (for example, via a published fee schedule, an in-app disclosure, or a written agreement).
5. Payments and Third-Party Services
- Payments are processed by Stripe and may use Stripe Connect to route proceeds to verified host accounts. Stripe may process payments and route funds according to your Stripe Connect configuration (including connected account routing). SnapDraw does not store complete card details.
- Stripe fees: Stripe charges payment processing and (where applicable) payout/transfer fees. These fees are set by Stripe and may change over time. Fees are typically deducted by Stripe so hosts receive the net amount after Stripe’s fees. For current pricing, see Stripe’s published pricing for your region and product (e.g., stripe.com/au/pricing and stripe.com/au/connect/pricing).
- Stripe is responsible for collection, transmission, and storage of card data in accordance with PCI-DSS. We may store payment references such as Stripe Payment Intent ID, Checkout Session ID, Charge ID, and the Stripe receipt URL for support, reconciliation, and audit purposes.
- Email delivery is provided by Postmark. Account and application data are hosted on Firebase (Google Cloud). Use of these services is subject to their respective terms and privacy policies.
6. Refunds Policy
We aim to provide a fair and consistent refunds framework. By purchasing tickets, you acknowledge the following:
- No change-of-mind refunds: Refunds are generally not provided for change-of-mind or buyer’s remorse.
- Refunds may be granted for: (a) duplicate or accidental charges; (b) confirmed fraud or unauthorized transactions; (c) event cancellation by the host; (d) platform errors resulting in failure to deliver tickets or material defects.
- Process: Refunds are initiated by SnapDraw administrators via Stripe. Approved refunds revoke associated tickets and entitlements. Partial refunds may revoke tickets proportionally.
- How to request: Contact us at admin@snapdraw.com.au within a reasonable period after purchase. Provide your Payment Intent ID, Checkout Session ID, or Charge ID, and ticket codes.
- Host requests: Hosts may request refunds for buyers when necessary (e.g., event cancellation). Final approval is at SnapDraw’s discretion to protect buyers and platform integrity.
- Timeline: Approved refunds are processed via Stripe; bank settlement times vary by provider.
7. Privacy
We respect your privacy and handle personal information in accordance with applicable laws. This section summarizes our practices.
- Data we collect: Account information (name, email), raffle and ticket details (raffle ID, ticket codes, quantity), preferences (marketing opt-in, winner notification opt-in), support metadata (Payment Intent ID, Checkout Session ID, Charge ID, Stripe receipt URL), and technical logs.
- How we use data: To operate the Platform, fulfill purchases, send transactional emails (e.g., receipts, winner notifications), provide support, prevent fraud, and comply with legal obligations.
- Sharing: We share limited data with service providers (Stripe, Postmark, Firebase/Google Cloud). Buyer contact details and ticket information may be shared with the host for raffle administration (e.g., winner contact). We do not sell personal data.
- Security: We use industry-standard measures and reputable processors. No system is 100% secure; we encourage strong passwords and responsible account use.
- Retention: We retain data only as long as needed for the purposes above and to meet legal and compliance requirements. You may request deletion of your account subject to records we must keep.
- International transfers: Our processors may store data in jurisdictions outside your own (e.g., Australia, United States). We take steps to use trusted providers with appropriate safeguards.
- Your rights: Subject to law, you may request access, correction, or deletion of your personal information. Contact admin@snapdraw.com.au.
8. No Warranty and Limited Liability
- The Platform is provided "as is" without warranties of any kind, express or implied.
- We do not guarantee that raffle organizers will award prizes as advertised. We are not responsible for disputes, losses, or damages arising from use of the Platform or participation in any raffles.
9. Reporting and Enforcement
- Users may report suspicious or non-compliant raffles. We reserve the right to remove or suspend any raffle or user account suspected of violating these Terms.
- We cooperate with law enforcement and regulatory authorities as required.
9A. Platform Role & Indemnity
- Facilitator only: SnapDraw is a technology platform, not the organizer, operator, or promoter of any raffle. Organizers conduct raffles in their own name and are solely responsible for compliance.
- Warranties & indemnity: Organizers warrant that their raffles comply with applicable laws and agree to indemnify SnapDraw against claims, penalties, or losses arising from non-compliance.
- Takedown: We may suspend or remove raffles that appear non-compliant or present consumer risk, at our discretion.
10. Intellectual Property
All content, branding, and code associated with the Platform are owned by Snap Draw and protected by intellectual property laws. Users may not copy, reproduce, or distribute Platform content without written permission.
11. Account Termination
We may suspend or terminate your account without notice if you breach these Terms or misuse the Platform.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on the Platform, and your continued use constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
